Window cleaner withdraws request for permit

In the letter, he said his attorney advised him that a special-use permit was not necessary because he doesn’t have employees who occupy his dwelling and all the window-cleaning work is done off-site.
Mr. Kerchner told the city he would sell the truck used by an employee who would bring it to his property and the two would carpool to job sites in Mr. Kerchner’s own truck.
Mr. Kerchner said if the employee parks his personal vehicle on a public street, rather than his private property, the zoning ordinance would not apply because the employee would not come onto his property.
City attorney John Konecky said Mr. Kerchner could operate his business out of his residence and meet all 10 conditions of minor home occupations, according to a memo to the city council.
After more than four years of operating the business, Greg and Lisa Kerchner sought a special-use permit on Nov. 5 to continue operating the business under restrictions set by aldermen.
Several neighborhood residents came to that council meeting to oppose granting the permit. At the meeting, the council voted to defer voting on the request to give Mr. Kerchner time to find alternate arrangements to park company trucks and equipment.
Planning and redevelopment staff will follow up with the business to see that all zoning regulations are being met, the council was informed. If violations occur, the city will file a complaint with the Municipal Code Enforcement Service.
