Abutters to Pike Gravel pit file appeal
posted by admin in Sewer SepticAppeal has been made by abutters to the Pike Gravel pit off Littleworth Road to the Zoning Board of Adjustment concerning the decision of the Planning Board that the asphalt plant in the pit owned by Redimix has not been discontinued.
The public hearing will be held on Tuesday, Oct. 16, at 7 p.m. in the Town Hall. The abutters contend that since no activity has taken place at the asphalt plant since 2005 that the use has been forfeited under the town regulations. Redimix has submitted documentation contending that while the plant has not been used because of the slowdown in business, it has been kept on the ready.
The abutters are appealing the Planning Board’s decision — one which they contend is considered an administrative decision under state statute.
The Planning Board opened the hearing on the Redimix case on May 16 and heard testimony on June 6 and June 20, when it made its decision. The hearing will go on at the Planning Board meeting in October (unless Redimix asks for further delay), when other aspects of the proposal to replace the asphalt plant with a cement plant will be discussed further.
